Terms and Conditions
Please read these Terms & Conditions carefully before electing to use Mama Rentals. By placing an order for any product from this site, you agree to be bound by these Terms & Conditions. If you do not agree to our Terms of the agreement, then you may not use the service.
- If any damage occurs to the rental garment during the customers rental period they must immediately notify Mama Rentals with photos of the damage;
- Mindfully avoid getting any stains (perfume, spay tan, rock dust, grass, pollen) on the garment to avoid additional fees - this includes, but not limited to: holding the dress while you walk, at all times; Avoid sitting directly on any types of surfaces such as grass or rocks to avoid staining the back of the garments.
- The garment is for your use only. It must stay in your own possession and control for the entire rental period;
- Make no alterations or additions to the garment or in any other manner interfere with the garment; In rare circumstances where it is necessary, you must consult with Mama Rentals prior to doing so.
- Generally speaking, we have a "no fake tan" policy as fake tan can react with sweat and permanently stain fabrics. If the customer elects to use fake tanning products against our advice, they must apply at least 2 days prior to wearing the garment, and apply baby powder in areas such as underarm, under bra to prevent it from staining the garment; However, if permanent stains occur after all the pre-caution has been taken, you are still liable for damages.
- Return the rental garment in the pre-paid return satchel or postal box, along with the branded drawstring bag, before 3.30pm on the last day of their rental period.
- It is the customer's responsibility to ensure the satchel or postal box is lodged at a post office and a lodgement receipt is obtained. Dropping a parcel off at a street side post box will cause loss of tracking information and delays - if you have dropped the parcel at a street side box despite our advice, you will be responsible for late fees should delays occur.
- If you elect to pickup/drop off, place your Mama Rentals’ drawstring garment bag on the hook outside the front door, before the end of your rental period.
- If you have misplaced or lost our drawstring garment bag, a fee of $5 (for a small bag) or $7 (for a large bag) will be incurred. Should the lost garment bag be retrieved later and returned to us, we will refund the fee charged. For shipping information, please contact us.
All customers must comply with a standardised Late Fee Policy that Mama Rentals will enforce to protect our services. Mama Rentals relies on customers returning items in a timely manner.
If your return date falls on a weekend or public holiday, you must lodge your return by 3.30pm the following business day. If you pick up/drop off your order from our address (8/24-26 Forestville Avenue, Forestville NSW 2087) you must place your order on the hook, outside of our front door.
Mama Rentals keeps record of all returning tracking numbers to ensure they can keep records of what stage of the shipment the return satchel/box is at. It is not our responsibility if you do not properly lodge your return and the tracking is not showable on the Australia Post website. We therefore strongly suggest you return your satchel/box over the counter at your local post office and obtain a lodgement receipt. If you drop off your satchel/box at a street side post box against our instructions, late fees will apply. Late fees for post box drop offs will be calculated from the date that return is due, until the date the first status update or scan is shown on the Australia Post website.
For each day a garment is late, a fee of 20% of the rental price is charged. By choosing to not pay a late fee or return your garment is a direct violation of Mama Rental's Terms & Conditions.
Mama Rentals reserves the right to contact your local police to make them aware of the matter.
Late fees will be capped at 2 weeks or up to 150% of the RRP of the item, whichever is larger, unless otherwise determined by Mama Rentals in their sole discretion.
After 2 weeks, if the order is not returned, we will ask you to pay the fee via bank transfer. If however you do not make the payment in time, Mama Rentals reserves the right to charge the credit card on file, plus a 3% card surchage, or otherwise collect payment from you and pursue any avenues available to Mama Rentals in this regard. If we are unable to charge the credit card on file, or otherwise collect payment from you, you agree to remit payment for the additional rental period (if applicable). Unpaid invoices will be passed on to a debt-collection service. The customer is liable to pay for the recovery fee as well as their late fee.
Try On garments must be returned within 24 hours of delivery, according to Australia Post's tracking. Garments need to be returned in their original, unworn condition. If we find any stains, body odour, strong perfume, or any other signs of wear upon their return, we will treat it as a full 4 day rental and charge the remaining balance through your credit card, or through other methods available. We have full discretion to ascertain whether a garment is in worn condition, the burden of proof does not lie with Mama Rentals.
As Try On bookings are NOT rental bookings, please be aware that we cannot guarantee on time delivery for them. We generally send out Try On orders one business day before your selected delivery date. Your Try On 24 hour period starts from the moment that it is delivered by Australia Post. If your Try On garment arrived later than your selected delivery date, your return date is on the day after you receive them.
If you are using the Site or Services and you reside in Australia, you are contracting with Mama Rentals (ABN 75437145028). By using the Site you agree to comply with and be legally bound by the terms and conditions of these Terms of Service ("Terms"), whether or not you become a customer user of the Services.
The customer agrees to pay all amounts due in clear funds from the date of invoice for the product and services provided by Mama Rentals. The customer agrees that if he/she fails to pay in accordance with this clause Mama Rentals may withhold the rental with no refund, exchange or credit.
Once a rental fee has been paid, it is strictly non-refundable. customers can contact Mama Rentals 7 days prior to their rental date to request a change of date (granted the new rental period is free) or a store credit. Not all requests can be granted but Mama Rentals will endeavour to do what works best for the customer whenever possible. If the rental period is within 3 days the order cannot be changed. All fees are final.
All customers’ debit or credit card is stored when placing an order online. Mama Rentals reserves the right to charge this card any additional fees including late fees or damaged or stolen goods along with a 3% card surcharge fee. These cards will be recorded and kept in a third party app for security. Clients personal sensitive data is securely saved.
Mama Rentals reserves the right to charge the customer 150% of the Recommended Retail Price (RRP) to replace a damaged or stolen garment.
If unpaid, after 14 days the card used at checkout will be charged. If the card used to pay for the original order is is unable to be charged, this fee will turn into a debt and will be passed onto our debt collectors. The customer is liable for recovery debt collector’s fees as well as Mama Rentals fee.
In the instance where a garment can be repaired for an amount less than the RRP, Mama Rentals reserves the right to charge the customer the repair fee. If the garment is booked for a back-to-back rental and cannot be fulfilled due to the delay in repair of the garment, the customer is liable to pay an additional rental fee.
Mama Rentals advise clients to be extremely mindful when using fake tanning products, perfume, walking or sitting on rocks or grass when hiring a garment. In the event that a stain prevents a garment from being re-rented, Mama Rentals reserves the right to charge the client a dry cleaning fee, or 150% of the RRP of the garment.
Mama Rentals reserves the right to recharge the customer a hiring fee/late fee for any garment's that are not returned within the specified agreed period. A customer who loses or steals an item will be charged 150% of the garment's RRP along with a 3% card surcharge fee to ensure the item can be replaced. The customer accepts full responsibility for the safekeeping of the apparel.
Mama Rentals treats every rental garment with the absolute care and strive to ensure the highest hygiene and cosmetic condition. If the customer disputes any product rented or service supplied by Mama Rentals, the client must notify Mama Rentals with their reasons within 24 hours after delivery or collection. The customer loses any right to dispute the quality of the product or service after this time period. Each garment goes through a checklist in which is examined thoroughly by Mama Rentals - therefore it is highly unlikely damages have been missed. Any minor faults and postage fees are non-refundable.
All online orders will be charged for express shipping to ensure timely delivery.
Mama Rentals cannot be held responsible for a non-delivery or delay in delivery after we have sent off the parcel. It is the client's responsibility to ensure the parcel can be delivered to the nominated address in time for their event. The client is not entitled to any compensation from Mama Rentals of any nature for any loss, damage or delay.
It is the customers responsibility to place the garment's in the return prepaid satchel or postal box provided and lodge to an Australian Post office within the rental return period. It is the customer's responsibility to ensure the satchel or postal box is lodged at a post office and a lodgement receipt is obtained. Dropping a parcel off at a street side post box will cause loss of tracking information and delays - if you have dropped the parcel at a street side box despite our advice, you will be responsible for late fees should delays occur.
In the event, a late fee is due, the customers card kept on record will be charged, along with a 3% card surcharge fee. If we cannot charge the card, the customers have 48 hours to pay the fees before they are handed to our debt collector. The debt collector's recovery fees will be at the customer’s expense.
If you have selected different delivery dates for different items in your order, they will be treated as separate orders, as they have to be shipped separately. In which case, we will send you an invoice to cover the additional shipping cost. Invoice must be paid before we can ship your order.
It is the customer’s responsibility to be aware that Mama Rentals charges a Card Charge Authorisation fee for all orders. This one time fee of $0.50 is set under a subscription and will capture the customers card details at checkout. It is Mama Rentals’ responsibility to ensure no additional amount are charged if the rental items are returned in time and without damages.
In the circumstances where the garments are returned late, damaged or stolen, Mama Rentals will manually add an additional product to your account and charge the card on file for the fees involved.
Mama Rentals will not send any parcel before the customer has paid for the Card Charge Authorisation fee via our online store.
The required Card Charge Authorisation will be held by Mama Rentals for the hiring, return postage, and laundering duration. If any Terms & Conditions has been breached by the customer, the customer forfeits their right to dispute the charges.
If the garment is not returned or damaged beyond repair the card number stored at time of release will be charged 150% of the RRP along with a 3% card surcharge fee.
The card stored on file will charge any additional fees including late fees, damaged fees, loss of sales due to late fees or damaged garments or replacement of the garment in subject.
If Mama Rentals does not to take their card number when collecting their order the above still applies. Mama Rentals will issue an invoice which must be paid immediately.
